The Intellectual Property Rights of the Philippines on Thursday night clarified that the Jalosjos-family-owned Television and Production Exponents Inc. or TAPE Inc. can still use the title “Eat Bulaga” or “EB” despite the recent decision of the said agency to side with the entertainment trio of “Tito, Vic, and Joey” or TVJ in their petition to dismiss the trademark registration TAPE Inc. noontime show title.
This was amid the statements made by the hosts of E.A.T., Vicente “Tito” and Vic Sotto, and Joey De Leon, that they already won the trademark complaint versus the producers of the noontime show “Eat Bulaga.”
In a decision on 4 December, the IPOPHL ruled that the triumvirate are the rightful owners of the “Eat Bulaga” trademark, giving weight to the testimony and explanation that was provided by brothers, Vicente “Tito” and Vic Sotto, and Joey De Leon.
“Until and unless the decision was already decided by the Supreme Court, then it is not yet final and executory. The winning party can still file an appeal the winning party with the IPOPHL-Bureau of Legal Affairs to execute our decision. But it is not automatic that the decision is executory,” said Atty. Rowel Barba, the director-general of IPOPHL in an interview with reporters, Thursday night.
